2. Terms of Service
Please read these Terms of Service carefully before engaging Hidden Rock Ltd for any excavation, transport, or supply services.
2.1. Agreement to Terms
By accessing our website, requesting a quote, or engaging our services (excavation, land moving, boulder supply, transport), you agree to be bound by these Terms of Service and all applicable laws and regulations of Mauritius. If you do not agree with any of these terms, you are prohibited from using or accessing this site or our services.
2.2. Service Quotes, Estimates & Validity
Quotes provided via this website, email, or verbally are estimates based on the information provided by the Client at the time. Final pricing is strictly subject to a formal site inspection and written contract agreement.
- Validity: Quotes are valid for 30 days from the date of issue unless otherwise stated.
- Adjustments: Hidden Rock Ltd reserves the right to adjust pricing in the event of unforeseen site conditions (e.g., unexpected rock hardness requiring specialized breaking, hidden underground structures, or water table issues) or changes in the scope of work requested by the Client.
2.3. Fleet & Equipment Hire ("Wet Hire")
Our standard operational model is "Wet Hire," meaning all machinery (excavators, 40T trucks, etc.) is supplied with our own certified and insured operators.
- Dry Hire: "Dry hire" (rental of machine only without operator) is not standard practice and will only be considered under specific written agreements requiring substantial security deposits and proof of insurance.
- Availability: While we strive to maintain high availability of our fleet, specific machinery is subject to prior booking. We operate on a first-come, first-served basis regarding scheduling.
- Minimum Charge: A minimum daily charge applies to all heavy machinery rentals unless otherwise agreed in a long-term contract.
2.4. Site Access & Underground Utilities
The Client is responsible for ensuring that the site is accessible to heavy machinery (40-ton trucks and excavators).
- Access: Any delays caused by lack of access or site obstructions may incur standing time charges.
- Utilities: The Client must identify and clearly mark all underground utilities (water pipes, electrical cables, fiber optics, etc.) before excavation begins. Hidden Rock Ltd shall not be held liable for damage to underground services that were not correctly identified or marked by the Client.
2.5. Payment Terms
Unless otherwise specified in a specific service contract:
- Invoicing: Invoices are issued upon completion of works or on a monthly basis for long-term projects.
- Due Date: Payment is due immediately upon receipt of invoice or within agreed credit terms (e.g., Net 30 days) for approved corporate accounts.
- Late Payment: We reserve the right to charge interest on overdue amounts at the prevailing statutory rate permitted by Mauritian law.
- VAT: All prices quoted are exclusive of VAT unless otherwise stated. VAT will be charged at the standard rate (15%).
2.6. Force Majeure & Weather Delays
Excavation and earthmoving are weather-dependent activities. Hidden Rock Ltd shall not be liable for project delays caused by events beyond our reasonable control, including but not limited to:
- Severe weather conditions (cyclones, torrential rain, flooding).
- Pandemics, strikes, or civil unrest.
- Government-mandated lockdowns or restrictions.
2.7. Limitation of Liability
To the fullest extent permitted by Mauritian law, Hidden Rock Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service.
3. Privacy Policy
Hidden Rock Ltd is committed to protecting your privacy. This policy outlines how we collect, use, and safeguard your information in compliance with the Mauritius Data Protection Act 2017 (DPA).
3.1. Data Collection
We collect personal data that you voluntarily provide to us when requesting a quote, submitting a tender query, or contacting us. This includes:
- Identity Data: Name, Company Name, Job Title.
- Contact Data: Phone Number, Email Address, Physical Address.
- Project Data: Site Location, Project Specifications, Architectural Plans (if uploaded).
- Technical Data: IP address, browser type, and version (via cookies for website analytics).
3.2. Purpose of Processing
We process your data solely for legitimate business purposes:
- Service Delivery: To prepare tenders, provide quotes, and execute contracts (e.g., delivering boulders, scheduling excavation).
- Communication: To respond to your inquiries and provide updates on project status.
- Legal Compliance: To comply with Mauritian tax laws (MRA), accounting standards, and safety regulations.
3.3. Data Sharing & Disclosure
Hidden Rock Ltd does not sell your data. We respect your confidentiality. We may share necessary data with trusted third parties strictly for operational requirements, such as:
- Subcontractors or specialized consultants (e.g., Laser Leveling Experts) required for your project.
- Safety officers or auditors for site compliance.
- Legal or financial advisors when required by law.
3.4. Data Security
We implement appropriate technical and organizational measures to secure your personal data against unauthorized access, alteration, disclosure, or destruction. However, please note that no method of transmission over the Internet or method of electronic storage is 100% secure.
3.5. Data Retention
We retain your personal data only for as long as is necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Typically, contract-related data is retained for a minimum of 7 years in compliance with tax regulations.
